Heard Mr. Dhruv Sirpurkar, learned counsel holding for Mr. S.V. Sirpurkar, learned counsel for the applicants and Mr. S.B. Bissa, learned APP appearing for the State. Perused the case diary.

The applicants are apprehending arrest in connection with Crime No. 105/2025, registered with Police Station, Civil Lines, Akola for the offences punishable under Sections 406, 417 and 420 of the Indian Penal Code.

Perusal of the case diary, more particularly the FIR reveals that complainant Mayur Sudhir Bachanwar was one of the aspirants interested in getting a job in Western Coalfields Ltd. The applicants and the co-accused came in contact with the father of the complainant through one Amol Khulekar. They assured to provide the job of Clerk to the complainant and demanded Rs.20,00,000/-.
2 49 aba757.25.odt According to the complainant, he paid an advance of Rs.8,00,000/- to accused no.2 who is the father and husband, respectively of applicant nos.1 and 2. Since, the complainant could not get the job as assured by the applicants, he demanded his money back. Inspite of repeated demands, the accused persons did not return the amount. When the father of the complainant demanded money, accused no.2 threatened the father of the complainant that he will commit suicide and implicate them in a false case. The complainant, feeling cheated by the accused persons, lodged the report against the applicants and the co-accused.

No doubt, there is a WhatsApp group in which the accused persons and the complainant as well as other aspirants who are interested in getting job in WCL are members. But it appears that no messages have been sent by the present applicants on the said group. They are only members of the said group. The main allegations of handing over the amount and threatening to commit suicide are against accused no.2. No amount was handed over to any of the applicants. The possibility of arraying the applicants as accused only because they are the daughter and wife of the main accused cannot be ruled out at this stage. Nothing is to be recovered from the applicants.

The applicants were protected by the order of this Court dated 07.10.2025 and as per the directions of this Court, they have attended the concerned police station

Considering the submissions and the material against the applicants, a case is made out for confirmation of the interim order dated 07.10.2025.

Accordingly, the criminal application is allowed. 8.
The interim protection granted to applicants vide order dated 07.10.2025 is hereby confirmed on the same terms and conditions, except condition no.(iv). 9.
The applicants shall attend the concerned police station as and when called by the Investigating Officer. 10.
The application stands disposed of in the aforesaid terms.
