The applicant is apprehending arrest in Crime No.598/2025 for the offence punishable under Sections 109, 351(3), 352, 189(1), 189(4), 190, 191(2) and 191(3) of the Bharatiya Nyaya Sanhita. 3.

One Anupkumar Giri lodged a report that he is working in the Godown of Arif Rashid Sheikh. On 18.9.2025 when he was standing in front of the godown, at that time, one pickup Bolero and one white coloured car came there and 5 to 6 persons stepped down with iron rod and wooden sticks. They asked the informant whether he works with Arif Sheikh, thereafter, they asked him the whereabouts of Arif Sheikh and Sonu Sahu. The informant told them that he is not aware about the whereabouts of them. Thereafter said persons started abusing him and asked him as to how he is not aware of the whereabouts of Arif Sheikh and Sonu Sahu. Then applicant told him his name as Karim Lala and asked to inform his employer that if he wants to do the business, he will have to pay Rs.10,00,000/- to him. The informant told him that he is not having mobile phone. The informant was then assaulted with iron rod on his back and then on

head. The informant sustained the injuries on his shoulder due to said assault. The applicant then threatened the informant of dire consequences and his associates started assaulting him by means of iron order and wooden sticks. After discharge from the hospital, informant lodged the report and crime came to be registered. 4.

The learned Advocate for the applicant has stated that medical report shows that all the injuries are of simple nature. The counter F.I.R. is there. There is compromise in between them and they have filed a joint affidavit before the Division Bench and on 11.11.2025 the Division Bench has passed the order and asked the Registrar to verify the contents in the affidavit. The learned Advocate for the applicant has submitted that custodial interrogation of this applicant is not necessary. Hence prayed to allow the application. 5.

Learned A.P.P. has pointed out the role of this applicant and stated that though the other co-accused are released on bail, the C.C.T.V. Footage shows that the applicant had assaulted with stick to the injured. Considering the role of the applicant and as the affidavit is not yet verified, requested not to grant the protection. Accordingly, prayed to reject the application. 6.

It appears from the record that two incidents took place and the counter F.I.Rs. are there. Both the parties have settled the matter between them and approached the Division Bench of this Court for quashing of F.I.Rs. As the matter is settled between the parties, considering the medical report in which the injuries are shown of simple nature, case is made out to grant the applicant anticipatory bail.

i) It is directed that in the event of arrest of the applicant- Karim S/o Sattar Patel, registered with Police Station Pardi, Distt. Nagpur, in connection with Crime No.598/2025 for the offence punishable under Sections 109, 351(3), 352, 189(1), 189(4), 190, 191(2) and 191(3) of the Bharatiya Nyaya Sanhita, the applicant shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one surety in the like amount.

ii) The applicant shall not in any way tamper with the prosecution evidence.

iii) The applicant shall not pressurize or threaten the prosecution witnesses.

iv) The applicant shall co-operate with the Investigating Machinery. v) The applicant shall attend the concerned Police Station once in a week on every Friday between 7 p.m. to 9 p.m. 7.

The application stands disposed of.
