The applicant has filed this application apprehending that the police will arrest him in crime of theft.

The applicant has applied for return of truck which was involved in theft of government property by filing suparatnama in the capacity of power of attorney of the owner of the truck. 3.

Yet the crime is not registered against this applicant. 4.

The Sessions Court has rejected the bail application filed by this applicant.

According to the learned A.P.P. yet no accused is arrested in crime, applicant is the only person who can disclose the name of the other co-accused who were present on the spot. 6.

The learned Advocate for the applicant has stated that the applicant has disclosed the name of the Driver. 7.

As the offence is not registered against this applicant, only because he is having an apprehension, the protection cannot be granted.

If the police have any suspicion or they find anything incriminating against this applicant, they may issue notice under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita. 9.

Accordingly, application stands disposed of.
