Ms. M.A. Barabde, learned A.P.P. waives notice for the non-applicant/State.

The applicants are apprehending arrest in Crime No.493/2025 for the offence punishable under Sections 74, 76, 115(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita.

It is alleged that quarrel took place between the applicants and the First Informant on 4.6.2025. Allegations in present F.I.R are made that when the First Informant asked not to construct on the side of her house, applicants pulled her hair, slapped her, torn her blouse and saree and gave fists and blows, therefore, the report was lodged and the crime is registered.

The learned Advocate for the applicants stated that the husband of the First Informant is in jail. The counter F.I.R. is lodged by these applicants against the First Informant. Hence, prayed to protect the applicants by granting ad interim protection. 7.
The learned A.P.P. opposed the application stating that the allegations are serious though the counter F.I.R. is there. Considering
aba788.2025.odt the allegations levelled against the applicants, prayed to reject the application.

Heard both sides and perused the record.

The incident took place on 4.6.2025. There is serious assault by the husband of the First Informant on the head of applicant No.1. He was in hospital for 7 days. Considering the allegations made against these applicants and as there is counter F.I.R., case is made out to protect the applicants by granting ad interim protection. i) It is directed that in the event of arrest of the applicants - Yugal S/o Tirthraj Bawanthade, Tirthraj S/o Ramji Bawanthade and Savita W/o Tirthraj Bawanthade in Crime No.493/2025 for the offence punishable under Sections 74, 76, 115(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, the applicants shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand each with one solvent surety in the like amount.
ii) The applicants shall not in any way tamper with the prosecution evidence.
iii) The applicants shall not pressurize or threaten the prosecution witnesses.
iv) The applicants shall attend the concerned police station on every Monday and Saturday between 7:00 p.m. and 9:00 p.m. v) The applicants shall co-operate with the Investigating Officer. 10.
