The applicant is apprehending arrest in Crime No.922/2024 for the offence punishable under Sections 420, 406, 409, 417, 418, 421, 424, 467, 468, 471, 477-A and 120-B of the Indian Penal Code and Section 3 of the Maharashtra Protection of Interests of Depositors (in Financial Establishments) Act, 1999.

The applicant was In-charge Branch Manager since 2018. The allegations of misappropriation in Mahila Sahakari Bank are made and the Directors and the employees who were working during that period are made accused.

The learned Advocate for the applicant has stated that some of the accused are protected by this Court and some of the accused are released on regular bail by the Sessions Court and even on anticipatory bail. The learned Advocate for the applicant has stated that the applicant is terminated from service in 2023 after departmental enquiry. The
2 3.aba.796.25 Liquidator came to be appointed in the bank. The applicant has submitted that the ground of parity is available, her role is not in the offence and C.E.O. is also protected by this Court. Hence, prayed to protect the applicant by granting ad interim anticipatory bail.

The learned A.P.P. has stated that some of the accused are already released on bail and are protected by this Court and the Sessions Court but considering the period in which the applicant was In-charge Branch Manager, the custody of the applicant is required. Hence, prayed to reject the application.

Heard both sides and perused the record.

Considering the period of the applicant and as she was terminated in the year 2023 and ground of parity is available, case is made out to protect the applicant by granting ad interim anticipatory bail.
i) It is directed that in the event of arrest of the applicant - Smt. Rajani w/o. Vilas Thakare in Crime No.922/2024 for the offence punishable under Sections 420, 406, 409, 417, 418, 421, 424, 467, 468, 471, 477-A and 120-B of the Indian Penal Code and Section 3 of the Maharashtra Protection of Interests of Depositors (in Financial Establishments) Act, 1999, the applicant shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one solvent surety in the like amount.
ii) The applicant shall not in any way tamper with the prosecution evidence.
iii) The applicant shall not pressurize or threaten the prosecution witnesses.
3 3.aba.796.25 iv) The applicant shall attend the concerned police station on every Monday and Saturday between 7:00 p.m. and 9:00 p.m.
v) The applicant shall co-operate the Investigating Officer.
10. This protection shall remain in force till next date of hearing.
