DATED : MAY 6, 2025 P.C.:
1.
Vide the present application under Section 482 of B.N.S.S. 2023 of claiming pre-arrest bail as the applicant is apprehending his arrest in Crime No.52/2025 registered with Police Station Nanded City, Pune, for the offences punishable under Sections 74, 75, 76, 77, 78, 79, 115(1), 351(2) & 352 of B. N. S. 2023.
2.
Mr. Kadam, learned senior counsel for the applicant, submits that both the applicant and the informant are from the legal profession. He states that, in the FIR, the entire chamber of the applicant has been implicated, including the female employees working
in the applicant's chamber. He further submits that his client has handed over his mobile phone along with its password and his laptop along with its password to the investigating officer. He submits that the applicant is a practicing advocate and has co-operated with the police. The applicant is ready to attend the police station as and when called. 3.
The learned APP submits that on the earlier occasion, the complainant has sought time since, she was appearing for her law examination. He submits that the law examination is over and now, the complainant is not picking up the phone calls of the investigating officer. He submits that since, the applicant has already co-operated with the police and the investigation is almost completed, the custody of the present applicant would not be necessary. 4.
After hearing the counsel for the parties and considering the documents on record and the fact that the applicant has co-operated with the investigating officer by handing over all his electronic gadgets including laptop and mobile phone along with its passwords, in my view, the custody of the present applicant, who is a practicing lawyer would not be necessary. Hence, I pass the following order.
