These applications are filed under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for seeking pre-arrest bail in connection with the First Information Report (FIR) No.114/2025 registered with the Karmala Police Station, Solapur Rural, for the offence punishable under Sections 15, 9, 3, 4, 3, 3(5), 303(2), 328, 62 of the Bhartiya Nyaya Sanhita, 2023.

This Court by an order dated 8/4/2025 directed both the applicants to attend the office of the IO and to cooperate with the investigation.

Accordingly, the learned APP informed this Court that both the applicants have attended the IO and cooperated with the investigation.

It is the case of the applicants that they are not the owners of the boats which were seized by the police. Both the applicant are residing 40 km. away from the spot where the raid was conducted. The names of the present applicants were alleged to be disclosed by the person residing in the neighbourhood where the raid was conducted. As regards the applicant Chagan Mane, who is also known as Tatya Mane, though their names were disclosed by the neighters of one Mr. Tatya Mane, however, the applicants are not the same persons who have been named by the neighbours where the raid was conducted. So also, it is their case that the seized boats are not owned by the present applicants. There is nothing to be recovered from the present applicants. There are no criminal antecedents reported against the present applicants. In my opinion, the case is made out to grant pre-arrest bail to the present applicants

ORDER
(a) The anticipatory bail applications are allowed. (b) In the event of arrest in connection with FIR No.114/2025 registered with the Karmala Police Station, Solapur Rural, the applicants shall be released on bail, on furnishing P.R. bonds to the extent of Rs.30,000/- each with one or two sureties each of the like amount.
(c) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence. (d) The applicants shall furnish details of their residential addresses, contact numbers and email addresses to the Investigating Officer.
(e) The applicant/s shall attend the concerned police station and meet the IO on 28/4/2025 and 29/4/2025 between 11.00 a.m. to 1.00 p.m. and thereafter, as and when called for. 5.
Needless to say that violation of any of the aforesaid conditions
Diksha Rane 61 ABA 815-2025 & anr..doc would make the applicants liable to face proceedings for cancellation of this anticipatory bail. It is also clarified that the observations made in this order are limited to the question of grant of anticipatory bail to the applicants in the present applications and that the trial Court shall proceed further, without being influenced by the observations made in this order.
