This is an application for anticipatory bail. 2.
The applicant is apprehending her arrest in Crime No.59 of 2025 registered at Achole Police Station, Dist-Mira Bhayander Vasai - Virar for the offences punishable under Sections 64(2)(D), 318(4), 336(2), 336(3), 340(2) of Bharatiya Nyaya Sanhita, 2023. 3.
It is the case of the prosecution that co-accused Yogesh Mankar had induced the first informant into physical relationship with him on the false promise of marriage. It is further alleged that the said co-accused had defrauded the victim to the tune of Rs.1,03,09,800/-. It is alleged that out of the said defrauded 1/3
amount, an amount of Rs.4,57,800/- was deposited in the bank account of present applicant.

I have heard the learned counsel appearing for the applicant, the learned APP for the respondent / State and the learned counsel for the respondent No.2/first informant. 5.
Learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that the applicant to show her bonafide had already deposited amount of Rs.4,57,800/- with the registry of this Court. It is submitted that the applicant has no objection if the first informant is permitted to withdraw the said amount.

Learned APP for the respondent No.1/State submits that the prosecution has already filed the charge-sheet against the applicant and therefore appropriate order may be passed. 7.
I have perused the FIR. The main allegations are against the co-accused Yogesh Mankar. Considering overall facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed.
ORDER
A) The Application is allowed.
B) In the event of arrest of the applicant in C.R. No.59 of 2025 registered at Achole Police Station, Dist-Mira Bhayander Vasai - Virar for the offences punishable under 2/3
Sections 64(2)(D), 318(4), 336(2), 336(3), 340(2) of Bharatiya Nyaya Sanhita, 2023, she be released on bail on executing P.R. Bond in the sum of Rs.25,000/- with one surety or two sureties in the like amount.
C) Respondent No.2/first informant is permitted to withdraw the amount of Rs.4,57,800/- deposited by the present applicant with the registry of this Court along with accrued interest, if any.

The Anticipatory Bail Application and the Interim Application are disposed of in the aforesaid terms.
