The applicant is apprehending her arrest in connection with Crime No.308/2025 registered with Police Station, Kotwali, Nagpur for the offence punishable under Sections 316(2), 316(5), 318(2), 336(3), 3(5) of the Bhartiya Nyaya Sanhita, 2023.

The prosecution case is that after the death of the husband of the informant, she got an amount of Rs.1.10 Cr. The main accused Ram Jagjivandas Vasani and the present applicant came to the house of the informant and pursued her for purchasing the policy. Thereafter, co-accused Ram Vasani took amount of Rs.90 lakh from the son of the informant from time to time for investing the same in Kotak Mutual Fund and accordingly, investment statements were given to the informant, which were later found to be false and fabricated. In fact, no amount was invested in Kotak Mutual Fund.

The role assigned to the present applicant is that she had been to the house of the informant to explain the policy. The main accused Ram Vasani, who is husband of the applicant, has already been arrested. It is informed by the learned APP that no amount has been transferred in the account of the present applicant; however, she was a nominee in her husband's bank account.

Considering the nature of allegation against the present applicant that she was only present in the house when the policy was being explained by her husband, coupled with the fact that nothing is required to be seized from the present applicant and the fact that the applicant is a woman, a case is made out for grant of anticipatory bail. The applicant has a fixed abode, there are no chances of her fleeing away from justice. Hence, the following order: (i) The criminal application is allowed.
(ii) In the event of arrest, in connection with Crime No.308/2025 registered with Police Station, Kotwali, Nagpur for the offence punishable under Sections 316(2), 316(5), 318(2), 336(3), 3(5) of the Bhartiya Nyaya Sanhita, 2023, the applicant - Sejal Ram Vasani, be released on bail on executing a PR bond of 25,000/- with one solvent surety ₹ in the like amount.
(iii) The applicant shall attend the concerned Police Station on every Tuesday and Thursday between 10.00 am to 02.00 pm for the next three weeks and cooperate with the investigating authority.
(iv) The applicant shall not tamper with the prosecution evidence and shall not threaten the prosecution witnesses. With this, the application stands disposed of. (M.W. Chandwani, J.) Wagh
