Heard Mr. Taskar, learned Counsel for the Applicants and Mr. Metkari, learned APP for the State.

By this Application filed under Section 438 of the Code of Criminal Procedure, 1973 ("CrPC"), the Applicants are seeking prearrest bail in connection with CR No. I-34 of 2016, registered with the Sarkarwada Police Station, District - Nashik, for the offences punishable under Sections 406, 409, 420 and 120B of the Indian Penal Code, 1860 and Sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999.

Although, FIR was registered on 4th February 2016, the Anticipatory Bail Application has been filed on 24th March 2025. 4.

Mr. Ajinkya Taskar, learned Counsel for the Applicant, states that summons to produce document under Section 91 of CrPC has been received on the WhatsApp by the Applicant No.1 on 7th January 2025 and therefore the Applicants filed Criminal Bail Application No.228 of 2025 in the Court of the learned Additional Sessions Judge, Nashik and the said Application was rejected.

The present Anticipatory Bail Application is filed as the learned Additional District Judge, Nashik has rejected the said Application by Order dated 11th February 2025.

Mr. Taskar, learned Counsel states that the Applicants are not absconding. On 22nd September 2025, all Applicants were personally present in the Court and submitted that they will co-operate with the investigation. Accordingly, by Order dated 22nd September 2025, all the Applicants were directed to attend Sarkarwada Police Station, Nashik on 22nd September 2025, 30th September and 1st October 2025. 7.

Mr. Taskar, learned Counsel states that accordingly, the Applicants have attended the Police Station.

Although learned APP states that the offence is serious, in the facts and circumstances of this case, the case is made out for grant of anticipatory bail. Hence, following Order is passed:

O R D E R

(i) In the event of arrest, the Applicants- Balkrushna Lakshaman Bhuvad, Mr. Prasad Balkrushna Bhuvad and Mr. Vivek Balkrushna Bhuvad be released on bail in C.R. No.34 of 2016, registered with Sarkarwada Police Station, Nashik, on executing P.R. bonds of Rs.15,000/- each and furnishing one or two solvent sureties in the like amount.

(ii) The Applicants shall attend the concerned Police Station as and when called by the Investigating Officer. (iii) The Applicants shall furnish their cell phone numbers and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(iv) The Applicants shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel. (v) The Applicants shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
