The applicant is apprehending arrest in Crime No.338/2025 for the offence punishable under Sections 316(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita.

It is alleged that the applicant and the first informant are the friends. They were having monetary transactions. The first informant has given an amount of Rs.32,00,000/- to start business. Thereafter also he has given the money. It is alleged that when the first informant asked for money, the applicant started avoiding him and, therefore, he has lodged the complaint.

The learned Advocate for the applicant has stated that earlier complaint was lodged before Gittikhadan Police Station but no cognizance was taken and thereafter Bajaj Nagar Police Station has registered the crime without having jurisdiction and the offence is registered against this applicant.

The allegations are made that the oral agreement was there. The applicant is not denying the amount given to him by the first informant.

Considering monetary transactions and the civil nature of the litigation, case is made out to protect the applicant by granting ad interim protection.
i) It is directed that in the event of arrest of the applicant- Akash Gurucharansingh Uikey, in connection with Crime No.338/2025 for the offence punishable under Sections 316(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, the applicant shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one solvent surety in the like amount. ii) The applicant shall not in any way tamper with the prosecution evidence.
iii) The applicant shall not pressurize or threaten the prosecution witnesses.
iv) The applicant shall attend the concerned police as and when called by the Investigating Officer.
v) The applicant shall co-operate with the Investigating Officer. 9.
