Mr. Ujjawal Phasate, learned A.P.P. waives notice for the non-applicant/State.

The applicant is apprehending arrest in Crime No.518/2025 for the offence punishable under Sections 123, 223, 274, 275 of the Bharatiya Nyaya Sanhita read with Sections 26(2)(i), 26(2)(iv), 27(3)(e), 3(1)(zz)(iv) and 59(i) of the Food Safety and Standards Act.

The raid was conducted as the information was received that scented tobacco is carried out in one vehicle. Said vehicle was stopped in front of the shop of this applicant.

The allegations are made that the applicant is the purchaser of said scented tobacco and, therefore, the crime is registered. 7.
The learned Advocate for the applicant has stated that the person who brought the tobacco to the doorstep of the shop of applicant is already taken in custody and released on bail. There is no role attributed to this applicant. Hence, prayed to protect the applicant by granting ad interim protection.

Heard the learned Advocate for the applicant and perused the record.

The earlier offence is also disclosed by the applicant. 10.
Considering the role played by this applicant and as the vehicle is already seized, case is made out to protect the applicant by granting ad interim protection.
i) It is directed that in the event of arrest of the applicant- Indrakumar S/o Sawaldas Nagdeve, in connection with Crime No.518/2025 for the offence punishable under Sections 123, 223, 274, 275 of the Bharatiya Nyaya Sanhita read with Sections 26(2)(i), 26(2)(iv), 27(3)(e), 3(1)(zz)(iv) and 59(i) of the Food Safety and Standards Act, the applicant shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one solvent surety in the like amount.
ii) The applicant shall not in any way tamper with the prosecution evidence.
iii) The applicant shall not pressurize or threaten the prosecution witnesses.
iv) The applicant shall attend the concerned police station on every Monday and Saturday between 7:00 p.m. and 9:00 p.m. v) The applicant shall co-operate with the Investigating Officer. 11.
