The applicant apprehends his arrest in connection with Crime No.518/2025 for the offence punishable under Sections 123, 274, 223, 275 of the Bharatiya Nyaya Sanhita, 2023 read with Sections 26(2)(i), 26(2)(iv), 27(3)(e), 3(1) (zz)(iv) and 59(i) of the Food Safety and Standards Act, 2006.

Heard learned counsel for the applicant as well as learned Additional Public Prosecutor for the non-applicant/State. I have gone through the case diary. 3.
It appears that a raid was conducted and contraband scented tobacco worth 5 lakhs alongwith a vehicle have ₹ been seized from one Lalit Gopaldas Rathi, who is the coaccused, who was arrested and later on released on bail. During investigation, the name of the present applicant was revealed. The material against the present applicant reveals that the vehicle containing contraband scented tobacco was parked in front of the shop of the applicant.

Considering the fact that the contraband scented tobacco is already seized as well as the nature of allegations against the present applicant, no custodial interrogation of the applicant is required. A case is made out for grant of anticipatory bail.

Needless to mention that, during the ad interim protection, the applicant has cooperated with the investigation. Hence, the following order:

The ad interim protection granted on 18.11.2025 is hereby confirmed.

Since, most part of the investigation has already been completed, the applicant need not attend the concerned police station in the present crime.
