DATED :- 07.04.2026 The applicant seeks anticipatory bail in connection with Crime No. 635/2024 registered with Police Station Beltarodi, Nagpur for the offences punishable under Sections 406 and 420 r/w. 34 of the Indian Penal Code.

Heard the learned counsel for the applicant as well as the learned APP for the State. I have gone through the case-diary.

It appears that the complainant- Nitesh Chaware lodged a complaint with the Police that he got connected with the applicant through a lady named Kalyani Jaipurkar, who is also a victim and one of the persons who paid money to get a job with Maharashtra Power Generation Company Ltd. (for short, "MAHAGENCO"). On 15.11.2019, Kalyani contacted the
2 48B-aba-876-25.odt complainant to inform that the recruitment process has started and demanded an amount of Rs.1,50,000/- from the complainant. However, he gave an amount of Rs.50,000/- in cash to her. Thereafter, on 23.11.2020, the complainant paid an amount of Rs.1,20,000/- to the applicant at his house in Chandrapur on the instructions of Kalyani. Again the complainant paid an amount of Rs.1,80,000/- to the wife of the applicant. On 30.03.2021, Rs.50,000/- was deposited in the account of son of the applicant. But, the complainant could not get the job and hence, he lodged the complaint with the Police and the aforesaid offences came to be registered against the accused persons.

It appears that similar type of offences are registered against the applicant wherein, he has been shown as the main accused in the crime, more particularly, in Crime No. 588/2025 registered with Police Station Umred, Dist. Nagpur and Crime No. 121/2025 registered with Police Station Nandanwan, Nagpur. Thus, it seems to be the modus operandi of the applicant to lure aspiring candidates on the pretext of providing job and to take money from them. Even after taking money, he neither provides a job to the candidate nor returns their money.

No doubt, in the present case most of the amount has been paid to Kalyani but prima facie she appears to have acted at the instance of the applicant.
3 48B-aba-876-25.odt The Sessions Court has granted bail to Kalyani by observing that the main role in the crime has been played by the applicant by luring the complainant with getting a job after payment of money. It appears that the applicant is involved in about four similar type of offences. Various angles are to be investigated by the Investigating Agency, including involvement of the other co-accused, more particularly the officers of the MAHAGENCO. Hence, custodial interrogation of the applicant is necessary. 6.
