This application is filed under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for seeking pre-arrest bail in connection with the First Information Report (FIR) No.362/2024 registered with the Vadgaon Police Station, Kolhapur, for the offence punishable under Sections 406, 409, 417m 420, 120-B read with 34 of the Indian Penal Code.

The learned counsel for the applicant submits that the applicant attempted to commit suicide yesterday at his native place by consuming a substance. At present, the applicant is in Apple Saraswati Multispeciality Hospital at Kolhapur. He is in serious condition. Out of the total twelve accused persons eleven accused persons have already been granted bail. The present applicant is
Diksha Rane 933 ABA 892-2025.doc accused no.2. The applicant is ready to cooperate with the police and the investigating machinery. The applicant has two children, one aged nine years and another aged three and half years. 3.
Going by the FIR, there appears to be a civil dispute between the applicant and the informant and only remedy would be there to file civil suit for recovery.

The learned APP submits that the informant is added as party respondent no.2.

Hence, issue notice to the respondent no.2, returnable on 21/4/2025. Apart from the Court notice, advocate for the applicant is permitted to serve the respondent no.2 by advocate's private notice by all permissible modes of service and file affidavit of service to that effect before the next date of the hearing.

In the meantime, taking into consideration that out of twelve accused persons, eleven accused persons have been granted bail, the charge-sheet against those persons has been filed and the fact that the present applicant is in ICU due to attempt being made by him to commit suicide, till next date of the hearing, no coercive steps be taken against the applicant.
