The applicants apprehend their arrest in connection with Crime No.313/2025 registered with Police Station, Khapa, District Nagpur for the offence punishable under Sections 143 of the Bharatiya Nyaya Sanhita, 2023 read with Sections 3, 4, 5 and 7 of the Immoral Traffic (Prevention) Act, 1956.

Heard the learned counsel for the applicant as well as learned Additional Public Prosecutor for the non-applicant/State.

Having gone through the record, it appears that pursuant to secret information received, a raid was conducted at Tiger Fort Eco Resort situated in the vicinity of Temburdoh wherein, in room No.110 eight women were found. Whereas, in room no.109, the applicants who were customers were apprehended. When the police officials were busy in further investigation, the applicants fled away from the scene. Therefore, on the complaint of the police officer,

48 aba898.25.odt the aforesaid offence came to be registered against the applicant and other co-accused.

It appears that though the applicants were present in resort but prima facie, there is no positive statement showing any overt act on the part of the applicants. They are shown as customers. Nothing is required to be seized from the applicants.

The applicants were protected by ad interim order 26.11.2025 and were directed to attend the concerned police station. Accordingly, they appeared before the concerned police station and cooperated in the investigation. 6.

Considering the nature of allegations and the role assigned to the applicants, custodial interrogation of the applicants may not be required and therefore, a case is made out for confirmation of the interim order dated 26.11.2025. 7.

The application is allowed. Interim order dated 26.11.2025 stands confirmed on the same terms and conditions.

The applicants shall attend the concerned police station as and when directed by the investigating officer. 9.
