The Applicant lady has approached this Court praying for grant of anticipatory bail in connection with Crime No. 69/2025, dated 11/03/2025, registered with Police Station Sakharkheda, District Buldhana for the offences punishable under Sections 318(4), 336(3), 338 of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS') and Section 3 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (for short, 'MPID') 2.

On 26/11/2025, this Court had granted ad-interim anticipatory bail to the applicant with the condition that, she shall attend the concerned Police Station as and when called by the Investigating Officer. When the matter is listed today, it is informed that, the charge-sheet is filed and the applicant has secured the bail from the jurisdictional court also. On further inquiry, the learned APP for the State has fairly submitted that, not a single rupee was credited in the account of the present

2 13) ABA 899-2025.odt applicant. In this background, the present application is being considered.

The case of the prosecution in brief is that, certain gold ornaments were pledged with the Co-operative Credit Society, which was found to be of inferior quality/fake and loan amount of Rs. 59,27,500/- was sanctioned on the basis of such pledging. 4.

It is the case of the applicant that, her father-inlaw was engaged in the business of sale and purchase of the gold and the gold ornaments in question were belonging to her in-laws. It is also clear that, the husband of the present applicant was valuer of the Credit Society. Though the allegations are made against the present applicant that she had made various applications for obtaining the loan, the learned counsel for the applicant submitted that the charge-sheet is bereft of any material to that effect. There is one more fact i.e. filing of the chargesheet before the jurisdictional Court, which shows that the investigation against the applicant is also complete. Considering the fact that, the applicant is lady and vide order dated 26/11/2025, she was granted ad-interim relief and it is not even the case of the learned APP that, she had not co-operated with the investigating agency, I am inclined to pass the following order:-

ORDER

i) The Criminal Application (ABA) is allowed.

3 13) ABA 899-2025.odt ii) The order passed by this Court dated 26/11/2025, granting ad-interim anticipatory bail, is confirmed. iii) In the event of arrest, in connection with Crime No. 69/2025, dated 11/03/2025, registered with Police Station Sakharkheda, District Buldhana for the offences punishable under Sections 318(4), 336(3), 338 of the BNS and Section 3 of the MPID, the applicant shall be released on furnishing a P.R. bond of Rs. 50,000/- (Rupees Fifty Thousand Only) with one solvent surety in the like amount.

iv) The applicant shall not tamper with the prosecution evidence or influence the witnesses and remain present on each and every date of the Trial.

v) The applicant shall not leave the India without prior permission of the Court.

vi) The applicant shall attend the concerned police station as and when directed.

vii) Accordingly, the Application stands disposed of. (RAJNISH R. VYAS, J.) B.T.K.
