The learned A.P.P. waives service of notice for non-applicant/State.

The applicant has apprehension of arrest in Crime No.378/2025 registered with Police Station Hudkeshwar, District Nagpur for the offences punishable under Sections 120-B, 409, 419, 420, 465, 466, 467, 468, 471 and 473 of the Indian Penal Code.

The case of the prosecution is that, one Suresh Dhamgaya has lodged the report against the husband of the applicant namely Lawerence Henry and Shilpa Udapure (Shilpa Lawerence Henry), alleging that they gave assurance of giving job from the Minister Quota and duped him. The applicant has paid Rs.2,00,000/- by R.T.G.S. to him. Thereafter, the husband of the applicant Lawrence Henry told the informant that the interview of the informant is arranged in Mantralaya. Thereafter, fake interview was arranged in Mantralaya. The documents of the informant were verified. The informant was informed by the Lawrence Henry that the appointment letter of the
2 2.aba.903.25 informant is ready. Therefore, he has to pay another Rs.2,00,000/-. Accordingly, Rs.2,00,000/- were paid through R.T.G.S. in the account of Nexux H. R. Solutions. The accused No.3 showed the appointment letter and again duped by Rs.1,50,000/- to the informant. Thereafter, he has duped other persons by taking money from them by giving assurance of job. It is alleged that fake appointment letter was shown which was allegedly issued from Revenue and forest Depatment, Mantralaya, Mumbai to the Civil Surgen, J.J. Hospital, Mumbai for medical examination of the informant and other persons. The allegations are made against this applicant and her family members. They have cheated the informant and other persons by Rs.1,38,64,000/-.

The learned Counsel for the applicant has stated that no specific role is mentioned against this applicant. The applicant is the wife of the accused No.3. Another First Information Report for similar allegations was registered at Police Station, Durgapur, District Chandrapur wherein the Hon'ble Apex Court has protected this applicant by granting ad interim anticipatory bail. Similar allegations are made against this applicant in this First Information Report, which is registered at Police Station, Hudkeshwar, District Nagpur. Hence, prayed to protect the applicant by granting ad interim anticipatory bail.

The learned A.P.P. opposed the application stating that in this case, the offence under Section 467 of the Indian Penal Code is registered. The forge documents i.e. medical certificate and appointment letter are given to
3 2.aba.903.25 the first informant. They duped many persons. Though the Hon'ble Apex Court has granted anticipatory bail in another First Information Report, the condition of attendance is imposed by the Hon'ble Apex Court. Therefore, the custodial interrogation of this applicant is necessary. Hence, prayed to reject the application. 8.
Heard the learned Counsel for the applicant and the learned A.P.P. for the State.

The allegations about forgery and cheating are there. It appears that the accused No.3 has cheated many persons by giving assurance of job and has given the forged documents i.e. appointment letters of Revenue and Forest Department. The accused No.3 is in jail. As the Hon'ble Apex Court has granted interim protection to this applicant in similar First Information Report, the applicant is protected by granting ad interim anticipatory bail. Accordingly, I pass the following order:
i] It is directed that in the event of arrest of the applicant in connection with Crime No.378/2025 registered with Police Station Hudkeshwar, District Nagpur for the offences punishable under Sections 120-B, 409, 419, 420, 465, 466, 467, 468, 471 and 473 of the Indian Penal Code, she shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one solvent surety in the like amount.
ii] The applicant shall not in any way tamper with the prosecution evidence.
4 2.aba.903.25 iii] The applicant shall not pressurize or threaten the prosecution witnesses.
iv] The applicant shall attend the concerned police station twice in a week i.e. on every Monday and Saturday between 1:00 p.m. to 2:00 p.m.
v] The applicant shall co-operate the investigation officer.
The protection shall remain in force till next date.
