Apprehending arrest, the applicant/original accused no. 2 has preferred an application in connection with the First Information Report No. 378/2025, dated 14/06/2025, registered with Police Station Hudkeshwar, District Nagpur for the offences punishable under Sections 120-B, 409, 419, 420, 465, 466, 467, 468, 471 and 473 of the Indian Penal Code, 1860 (for short, 'IPC'). 3.

In short, the case of the prosecution is that, one Suresh Dhamgaya/informant has lodged the report against the husband of the applicant namely Lawerence Henry and Shilpa Udapure (Shilpa Lawerence Henry), alleging that they gave assurance of giving job from the Minister Quota and duped him. The applicant has paid Rs.2,00,000/- by R.T.G.S. to him. Thereafter, the husband of the applicant Lawrence Henry told the informant that the interview of the informant is arranged in Mantralaya. Thereafter, fake interview was arranged in Mantralaya. The documents of the informant were verified. The informant was informed

2 10) ABA 903-2025.odt by the Lawrence Henry that the appointment letter of the informant is ready. Therefore, he has to pay additional amount of Rs.2,00,000/-. Accordingly, Rs.2,00,000/- were paid through R.T.G.S. in the account of Nexux H. R. Solutions. The accused No.3 showed the appointment letter and again duped by Rs.1,50,000/- to the informant. Other persons were also duped on the same ground and money was taken from them. It is alleged that fake appointment letter was shown which was allegedly issued from the Revenue and forest Department, Mantralaya, Mumbai to the Civil Surgen, J.J. Hospital, Mumbai for medical examination of the informant and other persons. The allegations are made against this applicant and her family members that they have cheated the informant and other persons by Rs.1,38,64,000/-.

The learned counsel for the applicant in the aforesaid background has argued that one more FIR on similar allegations was registered with P.S. Durgapur, District Chandrapur and anticipatory bail in that case was rejected by the Sessions Court and this Court also. The applicant then approached the Hon'ble Apex Court by preferring Criminal Appeal-2026 arising out of SLP (CRL) No. 19109/2025 and the Hon'ble Apex Court on 27/04/2026 granted anticipatory bail to the applicant. He has also tendered the copy of the order dated 27/04/2026 across the Bar, which is taken on record and marked as 'X' for the purpose of identification. He then argued that in the present matter also, the allegations are similar and therefore, considering the fact that the Hon'ble Apex Court

3 10) ABA 903-2025.odt has already decided the issue and further the applicant has attended the Police Station, she be extended the benefit of anticipatory bail.

Per contra, the learned APP for the State has submitted that though the applicant has attended the concerned Police Station, but she has not cooperated the investigating agency. The learned APP has not disputed the order passed by the Hon'ble Apex Court, but has argued that the investigation in the present crime is yet to be completed.

With the assistance of the respective learned counsels, I have gone through the record of the case. It is not disputed that, this Court by order dated 27/11/2025, has granted ad-interim anticipatory bail to the applicant with a condition that she shall attend the concerned Police Station on every Monday and Saturday. It is not disputed that the applicant has attended the Police Station. The order passed by the Hon'ble Apex Court dated 27/04/2026 reveals that the applicant was granted anticipatory bail in FIR No. 60/2025 registered at Police Station Durgapur, District Chandrapur, wherein the similar allegations were made, though the complainant was different.

Considering the order passed by the Hon'ble Apex Court and the fact that the applicant has attended the concerned Police Station, I am inclined to allow the present application. As far as the contention of the learned APP that the applicant is not cooperating the investigating agency, suffice it to say that just because the applicant is

4 10) ABA 903-2025.odt not giving the answers, which the Investigating Officer wants to record, would not amount to not cooperation. Hence, the following order is passed:-

ORDER

i) The Criminal Application (ABA) is allowed. ii) The order passed by this Court dated 27/11/2025, granting ad-interim anticipatory bail, is confirmed. iii) In the event of arrest, in connection with FIR/Crime No. No. 378/2025, dated 14/06/2025, registered with Police Station Hudkeshwar, District Nagpur for the offences punishable under Sections 120-B, 409, 419, 420, 465, 466, 467, 468, 471 and 473 of the Indian Penal Code, 1860 (for short, 'IPC'), the applicant shall be released on bail on furnishing a P.R. bond of Rs. Rs. 55,000/-- (Rupees Fifty Five Thousand Only) with one solvent surety in the like amount.

iv) The applicant shall attend the concerned Police Station as and when called by the investigating officer. v) The applicant shall cooperate with the investigating agency and shall not tamper with the prosecution evidence or influence the witnesses directly or indirectly. vi) The applicant shall not leave India without prior permission of the Court.
