DECEMBER 01, 2025 1) Heard learned counsel for the respective parties. 2) Issue notice to the sole respondent, returnable after two weeks.
3) Learned APP waives service of notice on behalf of respondent-State.
4) The applicant is apprehending arrest in Crime No.550/2024 registered with Police Station Gittikhadan, District Nagpur for the offence punishable under Sections 420, 406, 506 read with 34 of the Indian Penal Code (IPC).
5) It is the case of the prosecution that accused Nos.1 and 4 have book agency, namely, Balaji Book Agency, having owner name Chirag Kashinath Dey and Co-partner in the said business, Deepak Shivarshakar Maurya. The accused Nos.1 and 4 was purchasing various educational books from the complainant from time to time since 31/03/2024. The accused Nos.1 and 4 have purchased books worth Rs.76,68,006/- from the complainant between 31/03/2024 to 01/06/2024. Out of the said amount Rs.1,00,000/- has been deposited in the complainant's account of Indusland Bank. Accused Nos.1 and 4 have also agreed that they
2 01-aba 905.2025.odt would pay the balance amount within 90 days and a written agreement was entered into between them on 27/03/2024. Accused namely, Ranjit Chaudhary had directed the applicant and accused No.2 to sell the books in School which are of BCI company. Nowhere the name of the present applicant was mentioned in the FIR.
6) Learned counsel for the applicant stated that the applicant is employee and doing the work as per the instructions given by the employer/owner. She was the only employee and no active role is played.
7) Learned APP opposed the application and stated that she is absconding and other accused were arrested and released on bail. The anticipatory bail application was rejected by the Trial Court on the ground that she was absconding. Therefore, he prayed to reject the present application as well. 8) Considering the allegations made against the applicant, the case is made out to protect the applicant by granting ad-interim protection. Accordingly, I proceed to pass following order :-
O R D E R
i) It is directed that in the event of arrest of the applicant - Khushboo D/o Sanjay Gupta, in connection with Crime No.550/2024 registered with Police Station Gittikhadan, District Nagpur for the offence punishable under Sections 420, 406, 506 read with 34 of the IPC shall be released on ad-interim anticipatory bail on furnishing P.R.Bond of Rs.15000/- (Rupees Fifteen Thousand) with one solvent surety in the like amount.
ii) The applicant shall not in any way tamper with the prosecution evidence.
3 01-aba 905.2025.odt iii) The applicant shall not pressurise or threaten the prosecution witnesses.
iv) The applicant shall attend the police station twice in a week on every Monday and Saturday between 01.00 p.m. to 02.00 p.m. till filing of the charge-sheet.
v) The applicant shall co-operate with the Investigation Officer.
vi) The protection shall remain in force till next date.
