The learned Counsel for the applicant submits that the sole allegation against the present applicant is that he merely accompanied the informant and his mother to the office of the Sub-Registrar. The learned Counsel further submits that the applicant had no active role in the commission of the alleged offence and has not derived any financial or material benefit from the alleged transaction. The applicant is willing to cooperate with the investigation by attending the concerned police station and voluntarily surrendering his mobile phone for examination. Furthermore, the learned Counsel submits that the investigation has been completed, and a charge sheet __________________________________________________ 19 June 2025

Mamta Kale 12-aba-912-2025.docx has been filed against the co-accused. Notably, no notice under Section 35(3) of the Bharatiya Nyaya Sanhita, 2023 has been issued to the applicant, thereby indicating that no custodial interrogation of the applicant is warranted.

The learned APP seeks time to take instructions. 4.

By consent, stand over to 17 July 2025.

There shall not be any coercive action against the applicant in the present crime till the next date. 6.

In the meanwhile, the applicant shall attend the concerned police station on 23rd , 24th and 25th June 2025 between 11.00 a.m. and 2.00 p.m., surrender his mobile phone and cooperate with the investigation.
