Heard the learned counsel appearing on behalf of the applicant and the learned APP appearing on behalf of the State.

The applicant is apprehending arrest in connection with Crime No. 529/2025 registered with Police Station, Shegaon City, Dist. Buldhana for the offences punishable under Sections 115(2), 118(1), 118(2), 352, 351(2), 3(5) of the Bhartiya Nyaya Sanhita, 2023.

Perusal of the case diary reveals that the FIR was lodged by victim Shabana Parveen Mohd. Sadique stating therein that the daughter of her elder sister Rizwana Parveen, namely Saima Afrin Mohd. Yusuf got married with co-accused Sayyad Ali Sayyad Anis. There was a matrimonial dispute between them. Therefore, Saima was residing with her parents at Akola.

The alleged incident occurred on 06.10.2025 when the complainant, her elder sister and Saima went to the
2 51 aba913.25.odt matrimonial house of Saima. When they reached there, the house was locked. Saima unloked the house with the keys kept at the neighbour's house. After some time, Saima's mother-in-law came and she called her son Sayyad Ali i.e. Saima's husband. Sayyad Ali and other coaccused including the present applicant came there. Sayyad Ali asked them as to why they came to his house and asked them to leave. When they refused to leave, he assaulted the complainant and Saima using Iron pipe, due to which they sustained grievous injuries.

The allegation against the present applicant is that he also assaulted the complainant, her elder sister and Saima by means of iron pipe.

The case diary reveals that the iron pipe used by the applicant in the crime has been seized at the instance of the other co-accused. Nothing is required to be recovered from the applicant. The complainant has also been discharged from the hospital. There is no possibility of the offence turning into something severe. Considering all these aspects, custodial interrogation of the applicant may not be required. However, the applicant can be put to stringent conditions.

Accordingly, the criminal application is allowed. 8.
In the event of arrest of applicant - Shaikh Ahetesham Haider Shaikh Akram in connection with Crime No. 529/2025 registered with Police Station, Shegaon City, Dist. Buldhana for the offences punishable under Sections 115(2), 118(1), 118(2), 352, 351(2), 3(5)
3 51 aba913.25.odt of the Bhartiya Nyaya Sanhita, 2023, he be released on bail on furnishing a PR bond of Rs.25,000/- (Rupees Twenty Five thousand only) with one solvent surety in the like amount.

The applicant shall attend the concerned Police Station on every Tuesday and Friday between 10.00 am and 12.00 noon and cooperate with the investigation. 10.
The applicant shall not indulge in pressurizing the prosecution witnesses and shall not tamper with the prosecution evidence in any manner.

The application stands disposed of.
