The applicant is having apprehension of arrest in connection with Crime No.332 of 2024, registered with Police Station Hingna, Nagpur City for the offence punishable under Sections 108, 80,85 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, 5.

The applicant is the husband of deceased. She has committed suicide by consuming the poison. The allegations are made that after the marriage, the family members used

2 / 3 2-aba 916-25 to torture her and used to compel her to do all the household work.

6. The learned counsel for the applicant has stated that the general allegations are made against all the family members including mother-in-law, sister-in-law. Specific allegations against this applicant are not there that he used to torture her and because of which she has committed suicide. The applicant was in hospital, thereafter she was discharged and she was taken by her father. Dying Declaration is not on record. On the basis of oral dying declaration, the crime is registered. After going through the FIR, it appears that specific allegations against this applicant are not made. Though, the allegation about demand of money is there, the allegations of ill-treatment against this applicant are not made. Considering the contents in the FIR against this applicant, the case is made out to protect the applicant by granting him ad-interim anticipatory bail.

Accordingly, I pass following order:

i] By way of ad-interim protection, it is directed that in the event of arrest of the applicant- Sahadab Jabbar Sheikh, in connection with Crime No.332 of 2024, registered with Police Station Hingna, Nagpur City for the offence punishable under Sections 108, 80,85 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, he be released on bail

3 / 3 2-aba 916-25 on furnishing P.R. Bond in the sum of Rupees Twenty Thousand with one solvent surety in the like amount. ii] The applicant shall not in any way tamper with the prosecution evidence.

iii] The applicant shall not pressurize or threaten the prosecution witnesses.

iv] The applicant shall attend the concerned police station on every Monday and Saturday between 7:00 p.m. and 9:00 p.m.

v] The applicant shall co-operate the investigation officer.

7.

The protection shall remain in force till next date.
