Heard the learned counsel for the applicant and learned APP for the non-applicant/State. I have gone through the Case Diary.

The applicant is seeking anticipatory bail in connection with Crime No. 266/2025, registered with Police Station Sonala, Tq.Sangrampur, Dist. Buldhana, for the offences punishable under Sections 74, 115(2) and 333 of the Bharatiya Nyaya Sanhita, 2023 and Section 8 and 10 of the Protection of Children from Sexual Offences Act, 2012. 3.
It is contended that the applicant is the brother-inlaw of the complainant who lodged complaint against him alleging that the applicant on 24.10.2025 went to her house and grabbed her daughter inappropriately from the back. However, the victim girl somehow freed herself from the applicant. The victim girl made a phone call to her mother -
the complainant and informed the incident. Thereafter, the complainant reached home and lodged this complaint. 4.
It appears that the husband of the complainant who is the brother of the applicant, is no more. The relations between the complainant and the applicant's family are strained. It further appears that the complainant has also filed a domestic violence proceeding prior to lodging of this complaint.

Learned counsel for the applicant submitted that the complainant had already threatened the mother of the applicant that she will implicate the applicant in a false case. 6.
Considering the fact that the parties are not on good terms as well as the fact that proceedings have been filed by the complainant against the applicant, possibility of exaggeration of the incident cannot be ruled out at this stage. That apart, there is no allegation of assault. Whether the applicant was having ill intentions towards the victim girl is a matter of trial. Nothing is required to be seized from the applicant.

Learned APP submitted that most of the investigation is already over. Considering these aspects, custodial interrogation of the applicant may not be required. 8.
Vide order dated 8.12.2025, by way of ad interim
relief the applicant was protected by imposing certain conditions. As per the condition imposed, the applicant has attended the concerned police station and cooperated in the investigation. Hence, a case is made out for confirmation of the ad interim order.
In view of the above, the application is allowed. Interim order dated 08.12.2025 is hereby confirmed on the same terms and conditions.

The applicant shall attend the concerned Police Station as and when directed by the Investigating Officer. 10.
The applicant shall not threaten the prosecution witnesses and shall not tamper with the prosecution evidence.

The applicant shall not enter the territorial jurisdiction of Police Station Sonala, Tq. Sangrampur, Dist. Buldhana till filing of the Charge Sheet and shall not attempt to contact the victim in any manner.
