The applicant has apprehension of arrest in connection with Crime No.492 of 2025, registered with Shirpur Police Station, District Washim for the offences punishable under Sections 75(2), 75(3)and 78(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 8 and 12 of the Protection of Children from Sexual Offences Act, 2012(POCSO).

It is alleged that on 25/10/2025 at about 5.00 p.m. applicant was proceeding by front side of the house of informant. By seeing informant, he uttered words, "You are very beautiful and he liked her." He went near her and hold her right hand. On which she rescued anyhow. At that time, he threatened her that if she did not talk with him, he will defame her in the village. Thereafter her parents returned from Jalgaon. Thereafter she lodged the report. 6.
The learned counsel appearing for the applicant has relied on the judgment of this Court, wherein this Court has observed that if somebody proposes or tells a girl that he loves her, then it does not attract the offence of outraging the modesty. On perusal of the First Information Report, it self it appears that he told her that she is looking beautiful and he liked her. It does not reflects that there was any sexual intention. Considering the allegations made against this applicant, the case is made out to protect the applicant by granting ad-interim protection. Hence the following order:
i] It is directed that in the event of arrest of the applicant- Rahul Arun Mule, in connection with Crime No.492 of 2025, registered with Shirpur Police Station, District Washim for the offences punishable under Sections 75(2), 75(3) and 78(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 8 and 12 of the Protection of Children from Sexual Offences Act, 2012 he be released on bail on
3 / 3 5-aba 926-25 furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one surety in the like amount. ii] The applicant shall not in any way tamper with the prosecution evidence.
iii] The applicant shall not pressurize or threaten the prosecution witnesses.
iv] The applicant shall attend the concerned police station on every Monday and Saturday between 7:00 p.m. and 9:00 p.m.
v] The applicant shall co-operate the investigating officer.
