Heard Mr. Saurav Patil, learned Counsel appearing for the Applicant and Mr. Metkari, learned APP for the State. 2.

By this application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with C.R. No.762 of 2024 registered on 29th July 2024, with Yavat Police Station, Pune Rural, for the offences punishable under Sections 143(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 ("BNS") and 3,4,5 and 8 of Immoral Traffic (Prevention) Act, 1956.

It is the submission of Mr. Patil, learned Counsel for the Applicant that the name of the Applicant is not mentioned in the F.I.R. He submits that the Applicant has no criminal antecedents and is ready and willing to co-operate with the investigation. He further submits that the Charge-sheet is already filed. 4.

On the other hand, Mr. Metkari, learned APP strongly opposes granting pre-arrest bail to the Applicant. He submits that crime is very serious. However on instructions, he submits that the Charge-sheet is already filed.

The allegation against the co-Accused are inducing the victims in the present crime and compelling them to involve in the prostitution.

Perusal of record shows that although in the F.I.R., the name of the Applicant is not mentioned, during the course of the investigation, it was found that the Applicant is involved in the crime and even leave and license agreement of the said premises where said activities were conducted is in the name of the present Applicant. However, the incident in question took place on 29th

July 2024, the Charge-sheet is already filed on 15th December 2024. Thus, the investigation is completed. Accordingly, by imposing strict conditions, the Applicant can be granted anticipatory bail.

Accordingly, the Applicant is entitled to pre-arrest bail. Hence, following Order is passed:

O R D E R

(i) In the event of arrest, the Applicant - Ajad Kewat be released on bail in C.R. No.762 of 2024, registered with Yavat Police Station, Taluka-Daund, District-Pune on executing P.R. bond of Rs.1,00,000/- and furnishing one or two sureties in the like amount.

(ii) The Applicant shall attend the concerned Police Station once a week i.e. on every Sunday between 11.00 a.m. to 3.00 p.m.

(iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and

shall keep the same updated, in case of any change thereto.

(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(v) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
