The learned A.P.P. waives service of notice for non-applicant/State.

The applicant has apprehension of arrest in Crime No.394/2025 registered with Police Station Wathoda, District Nagpur for the offences punishable under Sections 420 of the Indian Penal Code.

The allegations made in this application are that though the Agreement to Sale was executed and the amount was paid by the complainant, the applicant has not executed the sale-deed and thereafter, the complainant came to know that he is not the owner of the property for which he has executed the Agreement to Sale.

The learned Counsel for the applicant has stated that the notice was issued by the complainant under the Negotiation Instrument Act as the cheques which were issued by the complainant were dishonoured. It appears that, the money transaction is there. Agreement to Sale was executed and the transaction was cancelled.

Considering the allegations made against this applicant, the case is made out to protect the applicant by granting ad interim anticipatory bail. Accordingly, I pass the following order:
i] It is directed that in the event of arrest of the applicant in connection with Crime No.394/2025 registered with Police Station Wathoda, District Nagpur for the offences punishable under Sections 420 of the Indian Penal Code, he shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one solvent surety in the like amount.
ii] The applicant shall not in any way tamper with the prosecution evidence.
iii] The applicant shall not pressurize or threaten the prosecution witnesses.
iv] The applicant shall attend the concerned police station on every Monday and Saturday between 1:00 p.m. to 2:00 p.m.
v] The applicant shall co-operate the investigation officer.
The protection shall remain in force till next date.
