The applicant is apprehending arrest in Crime No.411/2024 for the offence punishable under Section 489-B of the Indian Penal Code, 1860 (for short, 'I.P.C.').

It is the case of the prosecution that the amount of Rs.88000/- deposited by the applicant in the ATM Bank, out of which Rs.3500 of denomination of Rs.500/- were rejected by machine as counterfeit notes. It was deposited through ATM, the machine rejected said amount and the crime is registered against this applicant. Applicant has stated that one Nabab, who has requested

2 / 3 21 aba 939.25.odt. the applicant to deposit said amount in his account as he has to keep it for his health check up, therefore, the applicant has deposited it. He was not aware whether the counterfeit notes are there.

Learned APP for the State seeks time to file reply.

Considering the allegations made against the applicant. If the applicant was aware about said counterfeit notes he would not have deposited it in his own account hence case is made out to protect the applicant by granting ad interim anticipatory bail. 6.

It is directed that in the event of arrest of the applicant-Mohammad Aqib Mohammad Arif in connection with Crime No.411/2024 for the offence punishable under Section 489-B of the IPC, the applicant shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand Only with one surety in the like amount.

iii] The applicant shall not in any way tamper with the prosecution evidence.

iv] The applicant shall not pressurize or threaten the prosecution witnesses.

v] The applicant shall attend the concerned police station on every Monday and Saturday between 7:00 p.m. to 9:00 p.m.

This protection shall remain in force till next date of hearing.

Stand over after vacation.
