The applicant is apprehending arrest in Crime No.538/2025 for the offence punishable under Sections 316(5), 318(4) and 3(5) of the Bharatiya Nyaya Sanhita.

The allegations made against this applicant, who is the Sangam Manager of the Bharat Financial Inclusion Limited Company which gives loan, that this applicant along with other co-accused used to collect the instalment of loan amount and used to deposit it in the bank. There is huge misappropriation of amount of Rs.21,90,000/-. Two Branch Managers i.e. accused Nos.1 and 2 have taken responsibility of the amount which is misappropriated. They orally admitted that they are ready to repay the said amount and thereafter they have not responded to the calls and thereafter crime is registered.

As per the audit report the applicant was one of the Sangam Manager and responsible for the misappropriation upto 2,22,000/-. The show cause notice was issued to the applicant and she has not replied to the said show cause notice and thereafter she is suspended. The allegations against this applicant are of misappropriation. 7.

The learned Advocate for the applicant has stated that the trial Court has granted ad interim protection to the applicant and during that period she has attended the police station for 7 times and her statement was recorded. She is ready and willing to co-operate with the police machinery. The entire responsibility is taken by accused Nos.1 and 2. The custodial interrogation of this applicant is not required. Hence, prayed to protect the applicant by granting ad interim protection.

Learned A.P.P. opposed the application stating that amount is not Rs.22,00,000/- but it is more than Rs.81,00,000/- and considering the huge amount of misappropriation and the role of the applicant trial Court has rejected the application. Custodial interrogation of this applicant is necessary. Hence, prayed to reject the application.

Heard both sides and perused the record.

The allegations about misappropriation are there against the applicant who is Sangam Manager and used to collect the amount from the clients who have taken loan from the company and deposit it with the company. It appears from the record that accused Nos.1 and 2 have taken the responsibility of misappropriation. Considering the role of this applicant and as she has attended the police station 7 times during the interim protection granted by the trial Court, the

custodial interrogation is not required. Hence, applicant is protected by granting ad interim protection.

i) It is directed that in the event of arrest of the applicant - Kajal Dipak Kamble, in connection with Crime No.538/2025 for the offence punishable under Sections 316(5), 318(4) and 3(5) of the Bharatiya Nyaya Sanhita, the applicant shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand each with one solvent surety in the like amount.

ii) The applicant shall not in any way tamper with the prosecution evidence.

iii) The applicant shall not pressurize or threaten the prosecution witnesses.

iv) The applicant shall attend the concerned police station on every Monday between 7:00 p.m. and 9:00 p.m.

v) The applicant shall co-operate the investigating officer. 11.
