The applicant seeks anticipatory bail in connection with Crime No.1049/2025 registered with Kalmeshwar Police Station for the offences punishable under Sections 318, 336(1), 338, 340 of the Bhartiya Nyaya Sanhita, 2023.

The allegation against the present applicant is that he annexed a certificate mentioning that he is a resident of village Dahegaon; however, in fact, he does not reside there. Further allegation reveals that the certificate has been issued by one Shri P. P. Singanjude who was not the Secretary on the date of issuance of certificate. Therefore, the aforesaid offences came to be registered. 3.
It is contended on behalf of the applicant that under the dictum of this Court, the applicant has attended the concerned police station and co-operated with the investigation.

Per contra, learned APP objected to the application on the ground that the document itself shows that it is a forged one and even till date, no tax has been imposed just because certain compliances have not been made by the complainant.

Having heard the learned Counsels for the respective parties, I have gone through the case diary. It appears that the allegation against the present applicant is that he has obtained a forged certificate, which has already been seized. Custodial interrogation of the applicant is not required. Under the dictum of interim protection, the applicant attended the concerned police station and there is no complaint of non-cooperation by the investigating authority.

Considering the nature of allegations, more particularly when no person has come forward to say that he has been cheated or something has been misappropriated by the applicant by using that certificate, a case is made out for confirmation of the ad-interim protection granted by this Court vide order dated 16/12/2025. Therefore, the interim order passed on 16/12/2025 is hereby confirmed.
