Heard the learned counsel appearing for the applicant and the learned APP for the State.

The applicant is apprehending his arrest in connection with Crime No. 516/2025 registered with Police Station, Armori, Dist. Gadchiroli for the offences punishable under Sections 83, 65(3), 98 of the Bombay Prohibition Act, 1949.

Having gone through the case diary, it is revealed that the police tried to intercept one four wheeler - Maruti Suzuki Baleno car. However, the vehicle did not stop and was later found abandoned at a distance. The Police inspected the vehicle and they found more than 1400 bottles of foreign liquor, beer and country liquor in the said car. The police seized the entire stock. 4.

The allegation against the applicant is that he is the registered owner of the said car. Prima facie, the material on record does not show that the applicant was present on

2 62 aba957.25.odt the spot. Considering the fact that the vehicle as well as the liquor found in the car have already been seized, custodial interrogation of the applicant may not be necessary.

The applicant was protected by the interim order of this Court (Coram : Vrushali V. Joshi, J.) dated 18.12.2025. As per the directions of this Court, the applicant has attended the concerned police station and cooperated with the investigating agency.

Considering the material against the applicant and the fact that the vehicle and the liquor have already been seized, a case is made out for grant of anticipatory bail. 7.

Accordingly, the application is allowed.

The interim protection granted to the applicant vide order dated 18.12.2025 is confirmed on the same conditions, except condition No.(iv) of the operative order.

Instead, the applicant shall attend the concerned police station as and when directed by the Investigating Officer till filing of the charge-sheet.

The application stands disposed of in the aforesaid terms.
