By this application the applicant is apprehending arrest in crime no.531 of 2023 registered with Shahupuri Police Station Dist- Satara for offences punishable under Sections 380 and 454 of the Indian Penal Code, 1860.

It is prosecution's case that on 8th December, 2023, theft was committed in the flat of the first informant and gold ornaments around Rs.71100/- were stolen. The offence was registered against the unknown person. It is the allegations against the applicant that he has purchased the stolen gold ornaments of the first informant.

It is contention of learned counsel for the applicant that the applicant has been falsely implicated in this case. The coaccused have been released on regular bail. The allegations against the applicant that he has purchased the stolen gold ornaments. The applicant was not aware that the gold ornaments which he purchased were stolen gold ornaments. The applicant is a reputed person. Hence, requested to allow the application.

It is contention of learned APP that the applicant was aware that the gold ornaments purchased by him were stolen gold ornaments. The applicant has antecedents. Considering the allegations against the applicant, his custodial interrogation is required and requested to reject the application. 5.

I have heard both the learned counsel, perused the FIR and documents produced on record.

The allegations against the applicant are that he has purchased the stolen gold ornaments. The co-accused against whom there are allegations of theft, have been released on bail. Considering these facts, custodial interrogation of the applicant is not required and I pass following order :

O R D E R

I.

In the event of arrest, applicant be enlarged on bail in C.R. No.531 of 2023 registered with Shahupuri Police Station, Dist. Satara on furnishing P. R. Bond in the sum of Rs. 20,000/- with one or two sureties in the like amount.

II.

The applicant shall attend the concerned police station as and when required.

III.

The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

IV.

The applicant shall not indulge in similar nature of offences. If the applicant, indulges in such acts, it would be a ground to cancel his bail.

V.

Application is disposed of in above terms.
