The learned A.P.P. waives service of notice for non-applicant/State.

The applicant has apprehension of arrest in Crime No.0724/2025 registered with Police Station Warora, District Chandrapur for the offences punishable under Sections 318(4), 316(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is alleged that on 05.11.2025, one Mr. Bhagwan Hajare, informed the complainant that applicant has visited his house and conveyed that his friend Mr. Vinod Soyam (Accused No.1) intended to sell eight gold biscuits valued at Rs.96,00,000/- at a reduced price of Rs.90,00,000/- as he was in need of funds for the purpose of purchasing a property. Whereupon, the complainant and his associates acting on the said representation, collected an amount of Rs.81,50,000/- from various contributors including the complainant and his employer. On 05.11.2025, in the evening, the complainant and others

2 2.aba.966.25 met accused No.1 Mr. Vinod Soyam at Warora and went to his house. Accused No.1 along with the informant Mr. Rakesh Kondawar and the present applicant left in a car. They halted the vehicle near a temple, whereupon accused No.1 took two bags containing cash amounting to Rs.81,50,000/- and left the place. Thereafter, he allegedly postponed the delivery of gold biscuit on 06.11.2025 at Nagpur, failed to meet the complainant and promised to return the amount by 08.11.2025 but allegedly neither returned the said amount nor delivered the gold biscuits. 6.

The learned Counsel for the applicant has stated that the role played by this applicant is that he has introduced that Vinod Soyam with the complainant and complainant has given the amount without taking gold from him. The money is not taken by this applicant. The transaction is not between the applicant and the complainant. Only because he has introduced said person, the crime is registered against this applicant. Hence, prayed to protect the applicant by granting ad interim anticipatory bail.

Considering the role played by this applicant, the case is made out to protect him by granting ad interim anticipatory bail. Accordingly, I pass following order: i] It is directed that in the event of arrest of the applicant in connection with Crime No.0724/2025 registered with Police Station Warora, District Chandrapur for the offences punishable under Sections 318(4), 316(2) read with Section 3(5) of the Bharatiya Nyaya

3 2.aba.966.25 Sanhita, 2023, he shall be released on bail on furnishing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.

ii] The applicant shall not in any way tamper with the prosecution evidence.

iii] The applicant shall not pressurize or threaten the prosecution witnesses.

iv] The applicant shall attend the concerned police station daily between 6:00 p.m. to 7:00 p.m.

v] The applicant shall co-operate the Investigating Officer.

The protection shall remain in force till next date.
