The applicant seeks anticipatory bail in connection with Crime No. 588/2025 registered with Police Station Umred, Dist. Nagpur for the offences punishable under Sections 406 and 420 r/w. 34 of the Indian Penal Code.

Heard the learned counsel for the applicant as well as the learned APP for the non-applicant/State and Shri Hunge, learned counsel for assisting the prosecution. I have perused the case-diary.

It appears from the case-diary that the complainant- Manohar Bhusari got acquainted with a lady named Kalyani Jaipurkar, a friend of the daughter of the

2 48A-aba-968-25.odt applicant, who introduced the complainant to the present applicant and her husband- Waman Dambhare. Kalyani also stated that Waman Dambhare has good connections with the officers of Western Coalfields Ltd., Chandrapur and his son was also an officer with the Maharashtra Power Generation Company Ltd. and he can provide a job in either of the establishments by taking Rs.10 lakhs. If the job is not provided by him, then the amount will be repaid to him.

It is also alleged in the FIR that Kalyani, after consulting with the main accused- Waman Dambhare, informed the son of the complainant that he has to pay an amount of Rs.5 lakhs for starting the process of getting the job. Hence, on 30.06.2019 the applicant, main accusedWaman Damhare, their son- Kapil Dambhare and Kalyani went to the house of the complainant at Umrer wherein, the complainant paid an amount of Rs.5 lakhs in cash to them for getting jobs for his two sons. Again, from time to time, the son of the complainant, either by cash or through cheque gave an amount of Rs.10 lakhs to the accused persons. Inspite of giving money and taking regular follow-up with the accused persons, no job was provided to the sons of the complainant and therefore, a complaint came to be lodged by the complainant and the aforesaid offences came to be registered against the accused persons, including the present applicant.

The learned APP appearing for the State and Shri Hunge, learned counsel assisting the prosecution submitted that the amount has been returned by the applicant to the complainant.

The applicant is a lady and the entire amount has already been returned by the applicant to the complainant. Nothing is required to be seized from the applicant and consequently, custodial interrogation of the applicant may not be required in the matter. Rather, it appears that it is the husband of the applicant who has played the main role in the crime.

Considering these aspects, a case is made out for grant of extra-ordinary relief of anticipatory bail to the applicant. Hence, the following order:- i) The application is allowed.

ii) In the event of arrest, applicant- Kalawati W/o. Waman Dambhare shall be released on bail on executing a P.R. bond of Rs.25,000/- with one solvent surety in the like amount in connection with Crime No. 588/2025 registered with Police Station Umred, Dist. Nagpur for the offences punishable under Sections 406 and 420 r/w. 34 of the Indian Penal Code.

iii) The applicant shall appear before the concerned Police Station between 10:00 am to 12 noon on every Friday and Monday for the next two weeks and shall co-operate in the investigation.
