Heard Mr. Chetan R. Sharma, learned counsel appearing for the applicants and Mrs. H. N. Prabhu, learned A.P.P. appearing for the State.

The applicants are apprehending arrest in connection with Crime No. 532/2025 registered with Police Station, Shegaon City, Dist. Buldhana for the offences punishable under Sections 76, 115(2), 351(2) and 352 read with Section 3(5) of the Bhartiya Nyaya Sanhita, 2023.

The FIR shows that the complainant and the applicants are neighbours. There was an old dispute between the family of the complainant and the family of the applicants. On 09.10.2025 at about 9.00 pm, when the complainant, her daughter and son were present in their house, the applicants came inside the courtyard of
2 62 aba973.25.odt the house and started abusing and beating her. It is also alleged that the applicants, with an intention to outrage her modesty, tore the gown and also manhandled her. When her husband came to rescue her, the applicants beat her husband as well. On the basis of the said report, the aforesaid offences came to be registered against the applicants.

It appears that the alleged incident occurred due to an old dispute between the families of the complainant and the applicants. The applicants are the neighbours of the complainant. There is no allegation of use of any weapon by the applicants. Nothing is required to be seized from them.

Learned APP submitted that the charge-sheet has already been filed, which means that the investigation is complete.

The applicants were protected by the ad-interim order dated 24.12.2025. Under the orders of this Court, the applicants have attended the concerned police station and cooperated in the investigation. Therefore, custodial interrogation of the applicants is not required. 7.
Considering the nature of the offence and the manner in which the alleged incident of outraging modesty of the complainant has occurred, a case is made

Accordingly, the criminal application is allowed. 9.
The ad-interim protection granted by this Court (Coram : Mrs. Vrushali V. Joshi, J.) vide order dated 24.12.2025 is hereby confirmed on the same terms and conditions.

The application stands disposed of in the aforesaid terms.
