DATE : 23rd APRIL, 2025 P.C. :- This application is filed for pre-arrest bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Crime No. 128/2025 dated 7th February, 2025 registered with Yavat Police Station, Pune Rural for the offences punishable under Sections 74, 76, 115(2), 333, 351(2), 351(3) and 352 of the Bharatiya Nyaya Sanhita, 2023.

Based on the complaint, an FIR has been lodged. The role of the present applicant is mentioned in the said FIR. 3.

The applicant is a lady who does not have any criminal antecedent. The only allegation against the present applicant in the

2/4 FIR is that one Mr.Revannath entered into the house of the first informant and started abusing filthy language and started beating the husband of the first informant by fist and kick blows. When the first informant tried to intervene, the accused Revannath caught hold her shoulder, and touched her body parts inappropriate manner. The mother-in-law of the informant tried to rescue her. Even she was not spared. An FIR to that effect has been lodged. Therefore, the present pre-arrest bail application has been filed, the only allegation against the present applicant is that she was beating the first informant. 4.

Considering the fact that there are no grievous injuries and the fact that the present applicant is a lady who does not have any kind of criminal antecedents and is also mother of the two children aged 12 and 9 years old, so also the first informant has not produced any CC TV footage though there is CC TV installed in the house of first informant, the recording of the alleged incident has not been produced. Therefore, according to me this is a fit case to grant prearrest anticipatory bail. The present anticipatory bail application is allowed. Hence, the following order :-

ORDER

(a) The anticipatory bail application is allowed.

3/4 (b) In the event of arrest in connection with Crime No. 128/2025 dated 7th February, 2025 registered with Yavat Police Station, Pune Rural for the offences punishable under Sections 74, 76, 115(2), 333, 351(2), 351(3) and 352 of the Bharatiya Nyaya Sanhita, 2023, the applicant shall be released on bail, on furnishing P.R. bonds to the extent of Rs.30,000/- with one or more sureties of the like amount.

(c) The applicant shall co-operate with the investigation and attend and meet the Investigating Officer of the concerned Police Station on 28th April 2025 and 29th April 2025 between 11:00 a.m. to 1:00 p.m. and thereafter as and when called.

(d) The applicant should not directly or indirectly contact the first informant in any form whatsoever. (e) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and further, the applicant shall not tamper with the evidence

4/4 in any manner whatsoever.

(f) The applicant shall furnish details of his residential addresses, contact numbers and e-mail addresses to the Investigating Officer.

Needless to say, violation of any of the aforesaid conditions would make the applicant liable to face proceedings for cancellation of anticipatory bail. It is clarified that the observations made in this order are limited to the question of grant of anticipatory bail to the applicant in the present application, and that the trial Court shall proceed further, without being influenced by the observations made in this order.
