Since, the non-applicant/State in his reply has stated that First Information Report has not been registered on the complaint filed by the complainant and a preliminary enquiry is going on till date. The Investigating Officer is not sure whether the offence is committed and also no evidence is collected against the applicant. It is further stated that if any evidence is collected against the applicant then offence will be registered.

In wake of these submissions, the application can be disposed of by directing the Investigating Officer to give 72 hours advance notice if he intends to arrest the applicant in the crime which is alleged to be registered. RR Jaiswal
