DATED :- 07.03.2026 The applicant seeks anticipatory bail in connection with Crime No. 725/2025 registered with Police Station Darwha, District Yavatmal for the offence punishable under Sections 108 and 115(1) of the Bhartiya Nyaya Sanhita, 2023.

Heard the learned counsel for the applicant as well as learned APP for the State. Perused the casedairy. 3.

It appears that on 05.12.2025, deceased-Anil Pande committed suicide by hanging in the bathroom of his house. It appears from the First Information Report (FIR) that the deceased has mortgaged his house with the applicant against a loan of Rs.5 lakhs. The FIR further reveals that on 03.12.2025, the applicant had been to the house of the deceased to demand the loan amount from

2 25-aba-1006-25.odt the applicant and asked him to vacate the house if he cannot repay the amount. At that time, the applicant even slapped the deceased. The wife of the deceased lodged the complaint alleging that just because her husband could not pay the loan amount and was being harassed by the applicant for the same, he committed suicide.

It appears that there is allegation of only one incident against the applicant wherein, the applicant demanded the loan amount from the deceased and asked him to vacate the house and also slapped the deceased. There is no suicide note left by the deceased in this case. Whether the applicant harassed the deceased continuously, so that he was left with no option but to commit suicide is a matter of trial. It appears that the investigation is complete and charge-sheet is already filed, which goes to show that nothing is required to be seized from the applicant.

The applicant was protected by this Court vide ad-interim order dated 30.12.2025. Under the dictum of this Court, the applicant appeared before the concerned Police Station and co-operated in the investigation.

Considering the above aspect, custodial interrogation of the applicant may not be required. Hence, a case is made out of grant of anticipatory bail to the applicant. Hence, the following order:-

ii) The order dated 30.12.2025 granting adinterim protection to the applicant is hereby confirmed on the same terms and conditions.

iii) The applicant shall attend the concerned Police Station as and when directed by the Investigating Officer.
