The learned Counsel for the applicants submits that the applicants have not committed any offence as alleged. He contends that there are no specific allegations against the applicants regarding any ill-treatment or harassment of the deceased. The FIR does not attribute any particular overt act to the applicants that would amount to cruelty or abetment of suicide. He submits that during her lifetime, the deceased did not make any complaint against the applicants. In the absence

of any act of instigation or abetment, the essential ingredients of the offence under Section 108 of the Bharatiya Nyaya Sanhita are not fulfilled. The learned Counsel further points out that the allegations are primarily based on statements allegedly made by the deceased to her parents, which remain uncorroborated by any independent evidence. The only allegation against the applicants is that they failed to take any action despite being aware of the misconduct of the deceased's father-in-law. The learned Counsel further submits that the last incident referred to in the FIR occurred nearly two month's prior to the unfortunate incident of the deceased's suicide. There is also an unexplained delay of twenty days in lodging the FIR. The learned Counsel submits that the applicants are willing to attend the concerned police station, surrender their mobile phones, and cooperate with the investigation. The learned APP, on instructions, informs the Court that the investigation is almost complete, except for the seizure of the applicants' mobile phones.

In view thereof, the applicants are directed to attend the concerned police station on 4th, 5th and 6th July 2025 between 11.00 a.m. and 2.00 p.m., and cooperate with the investigation. In the meantime, no coercive action shall be taken against the applicants in the present crime until the next date.
