By the present Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with CR No.74 of 2025 registered with the Sahakar Nagar Police Station, Pune City,
for the offences punishable under Sections 142, 351(2), 64 and 64(2)(m) of the Bharatiya Nyaya Sanhita, 2023. 3.
It is the submission of Mr. Mishra, learned Counsel for the Applicant, that the Applicant and Respondent No.2 were in a love relationship and accordingly performed marriage under the Special Marriage Act, 1954. He submits that the Applicant and Respondent No.2 stayed together for about 3 months, and thereafter, the FIR was lodged.

Ms. Karnik, learned Counsel appointed to represent the interest of Respondent No.2, submits that although they stayed together for some period, thereafter the Respondent No.2 went to stay with her parents.

Ms. Newton, learned APP, submits that the Charge-sheet has already been filed on 17th April 2025.

A learned Single Judge has granted interim protection to the Applicant by Order dated 27th June 2025, which continues till
date. There is nothing on record to indicate that the said protection has been misused.

Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant - Kailas Raosaheb Borude, in connection with CR No.74 of 2025 registered with the Sahakar Nagar Police Station, Pune City, he be released on bail on his furnishing PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the concerned Police Station as and when necessary and shall cooperate with the investigation.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any
inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
