The learned Counsel for the applicant submits that, except for Section 74 of the Bharatiya Nyaya Sanhita, none of the other Sections invoked are non-bailable, and there is no allegation to attract Section 74 against the applicant. The main accused was arrested and released on bail. He further submits that the main accused in the case has already been arrested and subsequently released on bail. Additionally, there has been a significant and unexplained delay in the lodging of the FIR, which raises questions regarding the genuineness of the prosecution's case.
