DATE : 28th APRIL, 2025 P.C. :- This application is filed for a transit anticipatory bail since the applicant is apprehending arrest. A notice under section 35(3) of the BNSS was issued on 31st March, 2025 to the applicant to remain present before the concerned police station at Bilaspur, Chhatisgarh on 4th April, 2025. The learned counsel for the applicant submits that the applicant has not attended the concerned police station on 4th April, 2025 in the State of Chhatisgarh as he apprehended arrest. He submits that if the protection is granted to the present applicant, he

The learned A.P.P. submits that the notice under section 35(3) was issued to the present applicant. The present applicant could have attended the concerned police station at Chhatisgarh. He submits that the notice needs to be issued to the respondent no.2. 3.

Issue notice to the newly added respondent no.2, returnable on 6th May, 2025. Matter to come up under the caption of 'Urgent Circulation'.

The learned A.P.P. to serve the respondent no.2 through the Investigating Officer.

Apart from the court notice, the applicant is also permitted to serve the respondent no.2 by private service, by all permissible modes of service and file affidavit of service before the next date of the hearing.
