1) Heard Mr.Patil, learned Counsel for the Applicant and Ms.Kak, learned APP for the Respondent-State.

2) The Applicant is apprehending arrest in C.R. No.I-88 of 2025 registered with Manpada police station under Sections 316(2), 318(4) of Bharatiya Nyay Sanhita, 2023 on the report filed by Arvind Jadhav Rathod. 3) The prosecution case is that on 22/10/2020, the informant had booked and purchased a tenement in the under construction building constructed the Applicant. As agreed, the informant had paid Rs.13,00,000/- to the Applicant towards the said transaction. Even though 1/2

H.C. SHIV 12.aba1220.25.doc the building was completed, the Applicant did not give the possession of the subject tenement to the informant. Thus, the Applicant cheated the informant and misappropriated her money. Consequently, the informant filed the said FIR and present crime came to be registered. The anticipatory bail application filed by the Applicant before the Sessions Court was rejected. Hence, the Applicant has preferred this Applicant. 4) M. Patil, the learned counsel for the Applicant has submitted that during pendency of this Application the parties have arrived at a settlement. Pursuant to said settlement the Applicant has paid the settlement amount to the informant. To substantiate this submission, Mr.

Patil, learned Counsel for the Applicant has placed on record the statement of payments made by the Applicant enclosing the relevant bank statement and Affidavit of the informant (marked 'X' for identification). The Applicant was granted ad-interim relief vide Order dated 23/05/2025. The learned APP submitted that 'C' - Summary is already filed in this case. However, it is yet not accepted.

5) In the wake of above, the Application is disposed with following directions :- (a) Till acceptance of the 'C' - Summary report, the police shall not take coercive steps against the Applicant. (SHYAM C. CHANDAK, J.) 2/2
