Heard Mr Kaustubh Nale, the learned Counsel appearing on behalf of the applicant, and Mr Pankaj Deokar, the learned Additional Public Prosecutor representing the respondent/ State.

By this application, the applicant seeks pre-arrest bail in connection with CR No.152 of 2025, registered at Bangar
Nagar Police Station, Mumbai, for offences punishable under Sections 316(4) and 318(4) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023, and Sections 43(A)(j), 66 and 72 of the Information Technology Act, 2000.

The prosecution alleges that between December 2023 and February 2025, two employees of First Source Solutions Ltd., the applicant and the co-accused Reyyan Shaikh, conspired with Akash Bhande, an employee of Ananta Technologies, to violate a confidentiality agreement. They are accused of unlawfully disclosing and selling information, including user IDs and passwords belonging to the informant company, to coaccused Irfan Khan and Kojo, thereby committing data theft and breach of trust.

At the outset, the learned Additional Public Prosecutor representing the respondent/ State, based on instructions from the investigating officer who is present in the Court, submits that the investigation has reached its conclusion. He informs the court that a charge sheet will be filed shortly and clarifies that, apart from the retrieval of a mobile phone, there is nothing further to be recovered or discovered from the applicant. He also submits that the prosecution does not seek the applicant's custodial interrogation.

In light of the above, the present application stands allowed in the following terms:
(i) In the event of the applicant's arrest in connection with CR No.152 of 2025, registered at Bangar Nagar Police Station, Mumbai, he shall be released on bail upon executing a PR Bond of Rs.25,000/- and furnishing one or more sureties in the like amount.
(ii) The applicant shall attend the concerned Police Station as directed by the investigating officer, and surrender his mobile phone.
(iii) The applicant, himself or through any other person, shall not indulge in any activity that may tamper with the evidence or influence witnesses.
