This Court on 21.05.2025 made the following observations:

"1) Applicant is ready to refund the fraud amount of Rs.8,36,220/-, but the said amount is lying in the bank account of one Mr. Yogesh Vitthal Jagtap, which has been frozen in connection to this crime.

2) Ms. Shinde, learned A.P.P., on instructions from Mr. . . Pawar, Police Sub-Inspector, states К В that the Investigating Officer would intimate the bank concerned to de-freeze the said account to allow the Applicant/Account Holder to transfer the aforesaid amount to the bank account of the informant. Mr. Pawar, P.S.I. states that the aforesaid amount belongs to the informant and KARTIKEYA

26-ABA-1368-2025.odt said Yogesh Jagtap is not accused in this crime.

3) in view thereof, the aforesaid transaction be done on or before the next date, i.e. 29 May 2025. Till then, the Applicant shall not be arrested in the aforesaid crime, provided the Applicant attends before the Investigating Officer at Lasalgaon Police Station between 10.00 am. to 02.00 p.m. every day till the next date.

4) Stand over to 29 May 2025."

Mr. Ashok S. Gawai, learned APP for the Respondent, states that the Applicant has not complied with the said order. He states that the matter be placed before the Regular Court. However, he prays that the Applicant be directed to report to the Investigation Officer, Lasalgaon Police Station, Niphad, Nashik on 03.06.2025 and 06.06.2025 from 10.00 a.m. to 2.00 p.m. Applicant is directed to report to the Investigation Officer on the said date and time. Mr. Pradhan, learned Advocate for the Applicant states that the Applicant would appear before the Investigation Officer as directed. 3.

At the request of learned APP, list this Application on 10.06.2025.
