Heard Mr. Jadhwar, learned Counsel appearing for the Applicant and Mr. Mali, learned APP for the Respondent-State of Maharashtra.

By this Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with CR No.84 of 2025 registered with the Kalwan Police Station, District - Nashik for the offences punishable under Sections 109, 189(2), 190, 191(2), 191(3), 324(4), 324(5) and 333 of the Bharatiya Nyaya Sanhita, 2023.

It is the submission of Mr. Jadhwar, learned Counsel for the Applicant that the Applicant's name is not mentioned in the FIR and the Applicant is not connected with the crime. He further submits that a learned Single Judge by Order dated 17th June 2025 has granted interim protection which continued till date. He further submits that the Charge-sheet is filed and therefore as the investigation is completed, the Applicant be granted anticipatory bail.

On the other hand, Mr. Mali, learned APP strongly opposes the Anticipatory Bail Application. He submits that there is material on record to show that the Applicant is involved in the crime. On instructions, he states that the Charge-sheet is filed. 5.
Perusal of the record shows that in the FIR name of the Applicant is not mentioned. However, during the investigation role of the Applicant is disclosed. In any case, as the Charge-sheet is filed, the investigation is completed. The Applicant has been granted interim protection by the Order dated 17th June 2025. The said interim protection is being continued till today.

Mr. Mali, learned APP states that further investigation is going on. Mr. Jadhwar, learned Counsel for the Applicant states that the Applicant will cooperate with the investigation. 7.
Thus, in the facts and circumstances, the case is made out for grant of anticipatory bail.

In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant - Hemant Jayram Jadhav in connection with CR No.84 of 2025 registered with the Kalwan Police Station, DistrictNashik, he be released on bail on his furnishing PR Bond in the sum of Rs.50,000/- with one or two solvent sureties in the like amount.
(b) The Applicant shall attend the concerned Police Station on 27th October 2025, 28th October 2025 and 29th October 2025 between 11:00 am to 02:00 pm and thereafter as and when called by the Investigating Officer and shall cooperate with the investigation.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
(f) The Applicants shall not leave India without prior permission of the Court.
