Mr. Sameer M. Mangaonkar, APP for Respondent/State. --- CORAM : ASHWIN D.BHOBE, J.
DATE : 30TH MAY, 2025.
(VACATION COURT) P.C. :
1.
Heard Mr. Paramane, learned Advocate for the Applicants. 2.
Issue notice to the Respondent.
3.
Mr. Mangaonkar, Learned APP appears and waives service of notice on behalf of the Respondent-state. He states that he requires time to take instructions from the IO.
4.
Mr. Parmane, learned Advocate for the Applicants states that if the matter is being adjourned, he would request for interim protection,
as he has reasonable apprehension of Applicants being arrested. He points out to page 29 Exh. C of the paper book to state that during pendency of the criminal Anticipatory Bail Application No. 35 of 2025 before the learned Additional Sessions Judge, Khed, the Applicants were protected by interim bail.
5.
In view of the request for adjournment made by the learned APP and the apprehension expressed by the learned Advocate for the Applicants of being arrested, I am inclined to continue the interim protection as was granted by the learned Additional Sessions Judge, Khed in Criminal ABA No. 35 of 2025 which is referred to at page 29 and 30 of the paper book.
6.
Learned APP requests for imposition of an additional condition i.e. a condition that the Applicants should report to the Investigating Officer, Khed Police Station on 2nd, 4th, and 6th June from 10 a.m. to 12 p.m..
7.
Interim protection is granted to the Applicants on the terms recorded in the order dated 15.04.2025 passed in Criminal ABA No. 35 of 2025 read with the condition referred in paragraph-6 hereinabove, to continue till 10th June, 2025. 8.
It is clarified that I have not expressed any opinion on merits and
the interim protection is continued on the ground that the learned APP has sought time in the matter.
9.
List the matter on 10th June, 2025.
