Heard Mr. Shailesh Kharat, learned Advocate for the Applicants and Mr. Sameer Mangaonkar, learned A.P.P. for the State/Respondent. Perused the Application.

Perusal of this Application indicates that the Applicants had filed Anticipatory Bail Application No. 1716 of 2025 before the Court of Sessions at Pune. The Applicants were not secured by any interim bail. Though said Application is pending before the learned Sessions Court at Pune, the Applicants have filed this Application on 14th May 2025 seeking the following reliefs :- a.
Application on behalf of present Applicant may kindly and graciously be allowed.
b.
Applicant abovenamed may kindly be granted interim protection from arrest in connection with C.R. No. 132 of
2025 registered at Shirur Police Station, Pune Rural for offences punishable under Sections 118(1), 118(2), 119(2), 324(4), 351(2), 351(3), 352 and 3(5).
c.
Any other order or further orders in the interest of justice may kindly be passed.

Admittedly, Anticipatory Bail Application No. 1716 of 2025 under Section 482 of of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), is pending before the learned Sessions Court at Pune. 4.
Mr. Shailesh Kharat, learned Advocate for the Applicants states that till date the learned Sessions Judge at Pune has neither rejected any interim relief in the said Criminal Bail Application, nor disposed the said Criminal Bail Application. He states that the matter before learned Sessions Judge at Pune is scheduled on 5th June 2025. 5.
This Court upon having expressed a view of the present Application being not maintainable, in view of the pendency of Anticipatory Bail Application No. 1716 of 2025, Mr. Shailesh Kharat, learned Advocate for the Applicants seeks leave to withdraw the present Application. He, however, prays that this Court may consider directing the learned Sessions Judge at Pune to hear and dispose of Anticipatory Bail Application No. 1716 of 2025, pending before the said Court.

The statement made by Mr. Shailesh Kharat, learned Advocate for the Applicants on instructions of the Applicants is accepted and Anticipatory Bail Application No. 1423 of 2025 is dismissed as withdrawn.

As the Anticipatory Bail Application No. 1716 of 2025 is pending before the learned Sessions Court at Pune and the same is scheduled on 5th June 2025, this Court expects the learned Sessions Judge to consider the said Application on its own merits and in accordance with law and dispose
of the same at the earliest.

It is clarified that this Court has not expressed any opinion on merits.
