Heard Mr. Sumant Deshpande, learned Advocate for the Applicants and Mrs. Prajakta Shinde, learned A.P.P. for the State/Respondent.

Criminal Bail Application No. 2835 of 2025 filed by the Applicants under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), is pending before the Learned Ad-hoc District Judge-1 and Additional Sessions Judge, Pune, since 14th April 2025, as stated by the learned Advocate for the Applicants.

Mr. Sumant Deshpande, learned Advocate for the Applicants states that Criminal Bail Application No. 2835 of 2025 is heard till

date. He submits that the matter was adjourned from 30th April 2025, 2nd May 2025, 13th May 2025, 5th June 2025 and now fixed on 17th June 2025. He submits that in view of the above, the Applicants are unable to argue their case and seek appropriate reliefs. He submits that grave prejudice is being caused to the Applicants for the said reasons.

Mr. Sumant Deshpande, learned Advocate for the Applicants places reliance on the decisions of this Court in the cases of Shrenik Jayantilal Jain and Another v/s. State of Maharashtra1, Narayan Balaji Thakkar and Ors. v/s. The State of Maharashtra2 and Vishwanath alias Manoj Vasant Jare v/s. State of Maharashtra3 to submit that Applications for anticipatory bail are required to be considered expeditiously.

Mrs. Prajakta Shinde, learned A.P.P. for the State/Respondent does not dispute the aforesaid contentions of the Applicants, that Criminal Bail Application No. 2835 of 2025 filed by the Applicants, is pending since the month of April 2025. She on instructions from the Investigating Officer, Shirur Police Station, Pune Rural, fairly states that the learned Ad-hoc District Judge-1 and Additional Sessions Judge, Pune can be directed to consider and dispose of the said Criminal Bail Application at the earliest. She further on instructions from the Investigating Officer submits that pending the hearing and disposal of the said Criminal Bail Application, the Investigating Officer would not take coercive measures. This is a fair statement in the facts and circumstances of the present case. 2014 SCC OnLine Bom 549.

Anticipatory Bail Application No. 2772 of 2024 decided on 9th October 2024. Criminal Anticipatory Bail Application No. 2982 of 2022 decided on 20th October 2022.

In view of the above, the learned Ad-hoc District Judge-1 and Additional Sessions Judge, Pune is directed to dispose of the said Criminal Bail Application No. 2835 of 2025, scheduled on 17th June 225, within a period of 30 days from the said date, after affording a hearing to the concerned parties. The said Criminal Bail Application be decided on its own merits and in accordance with law.

Anticipatory Bail Application No. 1452 of 2025 is disposed of in the abovesaid terms.
