By this application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicants are seeking pre-arrest bail in connection with C.R. No.64 of 2025 registered with Mundhwa Police Station, Pune City, for the offences punishable under Sections 115(2), 117(2), 118(1), 3(5), 351(3) and 352 of the Bharatiya Nyaya Sanhita, 2023 ("BNS").

The prosecution case is set out in paragraph No.2 of the Order dated 14th May 2025 passed by the learned Additional Sessions Judge, Pune in Anticipatory Bail Application No.1416 of 2025, which reads as under :

"02. Brief facts of the FIR are such that, informant alleged that on 11/02/2025 at about 00.30 a.m. both applicants caused hurt to him by beating him by fist and kicks. He was searching for his father in the area near shop of applicants. It is alleged that both applicants caused serious hurt to the informant, because of which he required to take immediate treatment in the hospital. They have beaten her without any reasonable cause. They attempted to kill him by throttling him. He has filed report after taking treatment as he could not filed report initially because of injuries suffered by him. It is alleged that, applicant No.2 has also beaten informant by means of wooden log."

The position on record shows that the learned Single Judge by Order dated 3rd June 2025 has protected the Applicants. The Charge-sheet is already filed on 7th June 2025. The injuries are simple in nature.

Accordingly, the case is made out for grant of Anticipatory Bail to the Applicant. Hence, following Order is passed:

O R D E R

(i) In the event of arrest, the Applicant - (1) Rajendra Sopanrao Gaikwad and (2) Jaywant @ Sandeep Anil Gaikwad be released on bail in C.R. No.64 of 2025 registered with Mundhwa Police Station, Pune City, on executing P.R. bond of Rs.10,000/- and furnishing one or two sureties in the like amount.

(ii) The Applicant shall attend the concerned Police Station as and when called by the Police and shall cooperate with the investigation. (iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person

acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(v) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
